  2. Filing the Petition: One spouse (the petitioner) files a Petition for Dissolution of Marriage along with the required forms at the local courthouse.
  3. Serving the Other Spouse: The petitioner must serve the other spouse (the respondent) with the filed documents.
  4. Response from the Respondent: The respondent has 30 days to file a response. In an uncontested divorce, this response will agree to the terms laid out in the petition.
  5. Finalizing the Divorce: After the response is received and any necessary documentation is completed, the judge will issue the final Judgment of Dissolution once the 6-month waiting period has concluded. 

MANDATORY SIX-MONTH DIVORCE IN CALIFORNIA

California is a "no-fault" divorce state, which means that a couple can divorce without having to prove wrongdoing by either party. Once one spouse files a petition for divorce, California law requires a waiting period of at least six months before the divorce can be finalized. This waiting period begins from the date the respondent (the other spouse) is served with the divorce papers, not from the date the filing occurs.
